Administrative Proceedings

DNCT represents clients in various administrative proceedings before New York State Homes and Community Renewal (HCR), New York City Housing Preservation and Development (HPD), New York City Environmental Control Board (ECB), New York City Division of Human Rights (DHR) and U.S. Department of Housing and Urban Development (HUD). These administrative proceedings include rent regulatory issues such as rent overcharges and Fair Market Rent Appeals, as well as housing discrimination issues and housing code violations.

Appellate Practice

Representing clients before all Appellate Courts in the State from the Appellate Term, Appellate Division and New York Court of Appeals, as well as the Federal Court of Appeals. As a result of our appellate experience, some of our clients who are already at the appellate level have retained us to perfect their appeals after being unsuccessful at the trial level.

Cooperative and Condominium Board Representation

As general counsel to Cooperative and Condominium boards, we act on the board’s providing management advice and legal support on issues including collection of maintenance/common charges, acting as the transfer agent on unit sales, negotiating and litigating outside vendor contracts and amending governing organizational documentation such as bylaws and proprietary leases and Local Law 11 issues. We also work closely with management companies to ensure that the board is given the best counsel on all business decisions taking into consideration tax consequences and strategies.

Cooperative and Condominium Disputes

DNCT represents its many Cooperatives and Condominiums in many types of civil litigation including nonpayment of common charges and maintenance fees, breaches of outside vendor contracts, Sponsor related litigation, breach of fiduciary duty actions as well as discrimination actions commenced against the Cooperative or Condominium.

Commercial Disputes

DNCT handles numerous types of general commercial litigation including breach of contracts, brokerage commissions, actions for specific performance, arbitration, Amazon Seller and ASIN suspensions, construction litigation, insurance litigation, adverse possession, real property access rights, boundary disputes and easement issues.

Debt Collection

The firm handles a wide variety of collection matters concerning both consumer and commercial debts. The firm employs a number of collection representatives to aid in the recovery of past due receivables without the need for costly litigation.

Estate Planning and Litigation

Preparation and administration of wills and trusts as well as intestate administration. We handle such probate disputes as accountings, protection of spousal rights concerning elections against estates, undue influence, fraud, misappropriation of assets or lack of testamentary capacity, either to contest or defend a will or trust.

Landlord Tenant

DNCT represents both commercial and residential clients in connection with lease disputes involving residential and commercial properties including eviction summary proceedings based upon non-payment of rent and holdover proceedings based upon lease violations, Yellowstone Injunction actions, as well as representing clients in administrative proceedings before HPD, HCR, ECB and DHR.

Leasing

DNCT handles all transactional matters representing both commercial landlords and tenants involving restaurants, parking garages, shopping centers, commercial offices, and retail stores. We also often also negotiating brokerage and management agreements and financing and refinancing of commercial and residential properties.

Limited Liability Companies

DNCT can create your LLC including the company’s Operating Agreement which governs the company’s day to day management and business operations. We also handle all aspects of LLC disputes among members of the LLC including dissolution of the company.

Mortgage Foreclosure

DNCT provides foreclosure defense to corporate and individual property holders unable to make mortgage payments, including commercial mortgage refinancing. We are adept at negotiating with commercial lenders to try and find compromise options such as agreement to modify payment terms, extension of term length or a reduction in principal based on a drop in market value.

Partnership Disputes

DNCT can create your partnership including the partnership agreement which governs the partnership’s day to day management and business operations. We also handle all aspects of partnership disputes among partners including an action seeking an accounting, breach of fiduciary duties and dissolution of the partnership.

Real Estate Transactions and Financing

DNCT handles all transactional matters representing both commercial landlords and tenants involving restaurants, parking garages, shopping centers, commercial offices, and retail stores. We also often also negotiating brokerage and management agreements and financing and refinancing of commercial and residential properties. We handle all aspects of the sale and purchase of cooperatives, condominiums, and residential and commercial real estate. As General Counsel to many Cooperatives and Condominiums, DNCT acts as transfer agent in the sale or transfer of apartments.

Traffic Tickets

DNCT represents clients with traffic tickets in the Suffolk County and Nassau County Traffic and Parking Violations Agencies in Hauppauge and Hempstead, the Suffolk County District Court in Central Islip and the Nassau County District Court in Hempstead, and village courts throughout Nassau and Suffolk Counties, Southampton, Riverhead and other town courts. Getting one or two speeding tickets per year can put you at the threshold that triggers an automatic suspension of your driver’s license as you only need to accumulate 11 points in 18 months before your license is revoked. DNCT helps avoid or reduce points on your license which point result in increased insurance rates.
